Several states and cities have already adopted energy performance standards or carbon reduction initiatives that will directly impact buildings in the coming years, and additional mandates in other cities and states are expected to be approved in coming years. Making Plans to Adhere to Future Standards

There are over 30 additional jurisdictions throughout the country that are part of a national Building Performance Standards (BPS) coalition that are also expected to pass legislation.

Due to the nature of these new energy and carbon standards, it is critical to start planning for how to address these standards as soon as possible. Legislation has already been approved in the following locations:

  • Washington, Colorado, Oregon, and Maryland statewide
  • New York City
  • Boston
  • Washington DC
  • Denver
  • Seattle

What does this mean for buildings in these targeted areas?

Building Performance Standards are more stringent than other mandates such as energy audits, benchmarking, etc. because they mandate usage and/or carbon reductions, so this is performance-based legislation. Buildings must reduce energy usage to new target levels or meet new carbon reduction thresholds over time, with an end goal of net-zero emissions.

Depending on the location, this could be done through a variety of energy reduction, electrification, renewable energy, or other initiatives, including renewable energy credits in some cases. It’s important owners have strategies in place to meet these new energy and carbon standards as significant penalties may be assessed.

How can Burton assist?

Burton has direct experience in helping clients with large portfolios 1) stay informed about legislation as it is passed; 2) determine the status of buildings in each location; 3) determine strategies and pathways for compliance; and 4) inform owners and operators of potential penalties associated with non-compliance, which can be severe.

Burton develops compliance strategies through a recommended phased approach by leveraging our team of experienced energy engineers and analysts. Since this can take time to implement, we typically discuss with facilities as early as possible to determine the best, most cost-effective approach and the level of effort that would be involved.

In general, Burton engages in the following phases of work to help achieve compliance with the various Building Performance Standards:

Phase 1: State of Compliance

  • Determine which facilities need compliance documentation to be submitted.
  • Identify which facilities currently comply through the available pathway options.
  • Develop a roadmap for each impacted facility that does not meet the standards.

  • Perform energy audits for facilities that don’t meet the standards to develop measures and carbon reduction opportunities.
  • Assist with overall strategy and support implementation of energy efficiency measures that will bring the energy or carbon usage within compliance.
  • Determine if alternative compliance options are available and can be utilized to meet the requirements of the various programs.

Phase 3: Compliance Documentation and Submission

  • Assemble all required documentation per specific state or city requirements for all impacted buildings.
  • Submit all documentation and verify that compliance has been achieved.

It is a complex exercise to determine what is needed to meet the legislative requirements of each facility and location since all standards are different.
